El negocio del arrendamiento de bienes de capital o leasing lleva más medio siglo floreciendo en las Américas. En la actualidad, el hemisferio occidental maneja más de US$ 700 mil millones de dólares en inversiones vigentes en dichos bienes. La figura del leasing se basa en las competencias de los profesionales del Derecho, quienes la han venido desarrollando y sofisticando.
Las empresas Arrendadoras de América Latina ya mantienen un portafolio de inversiones alrededor de los US$ 100 mil millones de dólares, y su papel dentro de las economías nacionales es cada vez más importante. Sin embargo, el tratamiento jurídico del leasing sigue sometido en forma permanente a crecientes desafíos en todos los campos del Derecho, que obligan a los abogados a mantenerse alerta en relación con los problemas actuales e inminentes, y las soluciones que en otras jurisdicciones se les han dado a dichos problemas.
Desde 2008, The Alta Group Latin American Region, LLC ha venido organizando y moderando las ricas intervenciones y discusiones de los abogados vinculados a la industria del leasing. Los Foros anteriores han contado con la activa participación tanto de abogados internos de las empresas de leasing, como los funcionarios de las agencias de los Gobiernos que de una u otra forma regulan el leasing, así como los miembros de bufetes de abogados externos que representan a quienes ofrecen, quienes negocian y quienes disfrutan de los beneficios del leasing, y los funcionarios y profesionales de las firmas de consultoría y auditoria, y otros profesionales, incluyendo funcionarios de las áreas de operaciones de las empresas Arrendadoras.
Para este año, con ocasión del Quinto Foro Latinoamericano de Leasing, hemos preparado un programa de la mayor utilidad para los directores de operaciones de empresas de arrendamiento y financiamiento de equipos y para abogados practicantes. Diseñado para ser mucho más interactivo, práctico e ilustrativo, este Foro tocará a fondo los temas que hemos recibido de parte de todos los clientes y operadores de Alta, como motivos de especial atención. This is the ninth consecutive year that The Alta Group has conducted the Latin American Leasing Conference. The conference has become the meeting point for all leasing professionals in the region.
It has been customary at past Latin American Leasing Conferences to develop discussion themes that are the most relevant to members of the industry. As in previous years, the content of this year’s conference reflects the most important suggestions ofindustry members in the region.
This year, the conference will examine and discuss the future of leasing companies in the region, which face challenges imposed by the new global economic normal: challenges driven by innovation, the transition of the leasing business toward asset management, accounting and regulatory changes, bank-driven consolidation, funding challenges, and equipment vendor demands.
Important subjects that will be addressed includethe impact of future accounting standards for leasing, and the challenges for risk management and funding driven by Basel III. Furthermore, the conference will address innovation, and in particular how the region’s infrastructure development needs (energy, transportation, telecommunications, etc.) are creating opportunities for capital investment in Latin America and the potentially profitable participation of leasing companies in such economic development.
Similar to past years, we will examine the performance of the leasing industry in Latin America, using as a starting point recent data published in The Alta LAR100 report for the year 2010,Related discussion topics will be led by the main representatives of the leasing industry in the region.
In addition, there will be a special session where industry leaders will discuss the future of the leasing industry in Latin America. Since we expect attendees from Europe, the United States and China, there will be great opportunities to interact with these stakeholders to drive more business to the region.This is a unique chance to understand the actual status of the leasing industry in Latin America, and the legal, regulatory, accounting, tax and market issues affecting the industry.
In addition, all attendees will have the chance to network and exchange experiences with their colleagues and funding sources, and to meet representatives of the most important equipment manufacturers and vendors interested in contacting lessors to finance their sales.
